A Blogger’s Right?
I recently faced being told at work because of my previous blog that I was over-the-line. What happened is “someone” brought the information into the workplace and started to gossip about it. I never said anything about my blog to these people, especially about the previous posting. I even got in trouble. What gets me is one: my blogging is not at work, on duty, nor is libelous. I am within my First Amendment Rights to say what I did and to get in trouble for my blog was unreal.
I do not force people to come to my blog, not even on my MySpace page.
Take in for instance, if I said the same thing in the previous blog at a bar with friends and someone overhead it. Then, they brought that to work, then they should get in trouble, right? They are the ones bringing non-work topics that are inappropriate to work. It would not matter what is said at all.
Now, if I had said this at work, which I did not, then that would be a different story. After a bit of talking with my folks and some offtime hours with the family lawyer, I decided to check out ACLU which is the American Civil Liberties Union. From there, based on what I found, I went to the Illinois Department of Human Rights as this is a issue more suited to this area. I found a few things on rights, but not exactly about blogging, so I did more digging. I came upon EFF, the Electronic Frontier Foundation which has an indepth section about bloggers. Of course, I do not blog anonymously and never have, nor ever will. Under the section in “Blogging Without Getting Fired”, I believe number 5 suits some of my rights on How to Blog Safely. Furthermore, in their section of The Bloggers’ FAQ on Online Defamation Law under the question “What are some examples of libelous and non-libelous statements?” and the three FAQs after pretty much have made me a happy camper. None of what I blogged in the previous post were false, and my emphasized vernacular was merely opinion and the story behind it was not fallacious.
I have written the numbers to the three different offices as I am not sure which Mount Vernon falls over and will be calling them. When I was confronted at work, I informed them that I would possibly seek a lawyer, but I think IDHR might be able to handle the situation.
I know the post is a bit jumbled, but after spending 2 hours after 3AM, I am exhausted.

Wow. I’ve read articles about how to blog without getting fired, but I’ve never actually known anyone who got into trouble for their blog. Most of the articles I’d read said simply not to blog anything about your job. I think it’s stupid. Everyone in this country has a right to say what they want to, and just because someone got upset about the truth being told, that doesn’t give them the right to come back on you about it. Beside the fact that how is it that your blogging was over-the-line, but their bringing it up at work in the first place and gossiping about it wasn’t?
Exactly, that is what I said. I have gotten in trouble 2 times for the same thing; people bringing outside the work topics into the work area.
The first was a guy taunting and teasing because of a relationship I was having with a guy that I worked with. I do not know if if he got in trouble, but he should have for the damage he caused. He told others after someone told him, then physically came to ask us in a taunting manner on our whereabouts on a certain day.
Now for this, apparently the HR had been in contact with the company lawyers and they have been in the mess. I have already talked with a couple friends who are lawyers and I have been in my right. As said, my story was not false and calling them any name, even a bitch is not libelous.
I am feeling like when the Nazi sent out the SS in the Holocaust to harass Jews. This is discrimination and insane.
It is even a double standard going on. My friend was asked that day to turn over the phone number I called on her cell phone (because I use AT&T and unfortunately in my area, have bad connection) that I did DURING BREAK. When I confronted, I was given a bogus excuse, not even a valid explanation. My right to my privacy had been violated in that moment, even the girl who was asked. I have the real story from 2 other sides and those two match while the one I was given was the false one; trying to pit my own friend against me. I am pretty good at calling it and I just about wanted to blow up in her face for the embellishment. I can call whoever I want during break. It is my right!
SO, what to do… well, it is pretty obvious. I am not going to stop blogging, but I may have to even write Senator Shimkus, which would not be the first time I have contacted his office. We got his office to expedite Luis’ residency far more quickly, a year and a half faster than average due to my dad being a member of the Republican Party, a retired AF officer, and being a huge Shimkus supporter. I think the issue should be focused on more since the Internet has become a very strong medium and businesses forced to make a definite policy instead of not see the real facts and just pull out the hat an answer. The policies are out there and outlined in general. I remember being told by my dad that Quixtar (sister company of Amway) had sued 30 bloggers after they apparently said a lot of ‘defamation’ on their blogs. The case was dismissed in California in October 2007 due to their topics being non-libelous.

Now, my statements as it is, I should not have even been approached unless it was directly by the people affected by the statement. I am a big girl. I can take the heat.
I agree Charity, the ones who brought the disruptive behavior in should have been approached and reprimanded accordingly. I had not mentioned the blog post verbally at work and the only way to discover the blog is:
1- if you look up my name
2- if you go through my MySpace page
At least that is how I know according to my website stats. Considering Cpanel is awesome at telling me who visits my site, what ISP they use, and where they came from in reference from another page, I am tempted on blocking. However, I would be censoring myself, which would defeat the purpose of this blog post.
Oh god how dare anyone read your blog and then talk about it at your workplace. Who do those people think they are?? If your coworkers come here and read your blog of their own free will, they should at least give you the common courtesy of not talking shit about it. Wow.
I have heard about many bloggers getting into trouble about blogging about work. It’s ridiculous if you ask me. You should be able to state whatever you want to on YOUR site that YOU paid for.
I can understand about going overboard about talking about your life, and work but your posts aren’t over the top and doing cross the line. I believe. Some people just take things and blow them out of the water, especially when others are gossiping at work about what your site. Oi
